You are doing business in Thailand
Unlike most countries, there is no official notary public appointed by the government to authenticate signatures or documents in Thailand. Certification of signatures and notarisation of documents are then performed by Thai lawyers who have obtained the authorisation to provide notarial services. For certain matters, it is necessary to have the document legalised by the Ministry of Foreign Affairs following its certification by a notarial service attorney.
What is a notarial services attorney?
Notarial Services Attorney
In Thailand, notarial services are regulated by the Lawyers Council. A Thai lawyer who successfully passed the notarial training course can be registered as a Notarial Services attorney. Our notary services include:
- Authentication of signatures in a document
- Certification of the identities of each party in an agreement
- Administration of oaths and affirmation
- Certification of translations
- Authentication of title deeds
- Preparing power of attorney
- Witness the signature of a contract and other documents by the parties
- Coordination of the legalisation of documents
When doing business in Thailand and abroad, it is often necessary to obtain the notarisation of numerous documents such as Thai ID cards and passports, bank statements, power of attorneys, translation and company documents.
What is the legalization of a document?
Legalization of documents
The legalization of a document is the process by which a document is authenticating or certifying so a foreign country’s legal system recognises it as with full legal effect. As Thailand is not a party to the Hague Convention Abolishing the Requirement for Legalization for Foreign Public Documents (or Apostille Convention), a document which needs to be used outside of Thailand may need to be legalised. The legalization of documents is performed by the Ministry of Foreign Affairs.
In practice, the document is first notarised by a notarial services attorney who will then take care of the legalization process with the Ministry of Foreign Affairs.
Notary Services at Embassies
When a document issued in Thailand needs to be used in another country, it may be necessary to have this document notarised from the notary services of the relevant embassy. You can contact the embassy directly or ask our experts to coordinate the work. For France, we have French notary based in Thailand who can coordinate the notarisation of documents with France.
